Employment Law Compliance Audit
We will conduct an audit of your employment polices and procedures, ensuring that contracts comply with relevant legislation (The Labour Relations and Basic Conditions of Employment Acts as well as the Employment Equity Act) On conclusion of the audit we will furnish a report with recommended remedial measures.
Contracts
We are able to offer contracts of employment - tailor made to comply with the Basic Conditions of Employment Act or a specific Bargaining Council Agreements. Contracts may be permanent or fixed term in nature, depending on the individual requirements of each employer.
Policies
It imperative for workplace stability that employees are aware of the rules and regulations governing conduct in the workplace.
Employers seeking to enforce discipline for alleged breaches of rules and regulations will be required to prove that employees were made aware of the rules as well as the consequences for any breach of said rules
We will assist in drafting company policies and procedures including:
- Code of Conduct,
- Alcohol and Drug policy,
- Health and Safety policy,
- Employment Equity policy,
- HIV and AIDS policy
- Sexual Harassment policy.
- Grievance policy
- Leave policies (sick leave, maternity leave etc).
Discipline
It is imperative that Management understands the concept of progressive discipline. This is essential for harmonious workplace relationships as well as guaranteeing success in the event of an unfair dismissal dispute.
We are able to assist with the management of the disciplinary process (including equipping line managers with the skills to implement discipline in a fair and reasonable manner)
This service includes chairing disciplinary hearings and providing guidance through any possible CCMA/Bargaining Council process.
Retrenchments/Business Transfer
Where operational requirements dictate the need to reduce a staff complement, we are able to assist in managing the entire process from initial consultations with employees and the representative trade union to the conclusion of the process.
In the event of the transfer of part or all of a business as a going concern, we will assist in ensuring that the transfer of employee contracts comply with legislative requirements.
Union Negotiations/Strike Management
We have extensive experience in negotiations with various Trade Unions at Plant level. These negotiations include wage increases as well as other terms and conditions of employment. We will also guide employers on the rights enjoyed by trade unions depending on the level of representivity in the workplace.
In the event of unavoidable strike action, we will assist in drafting picketing rules.
